What constitutes a sex crime?

  • In Florida, there are three main categories of sex crimes:
  • Lewd and lascivious acts — These are sex crimes committed on a child who is under the age of 16 and includes forcing a child to engage in prostitution, soliciting a child under 16 to commit a lewd or lascivious act, and molestation, among others. Penalties for this offense are a minimum of seven to a maximum of 15 years in prison. However, the penalties depend on the age of the offender and whether there were mitigating circumstances (for example, if the child initiated the action).
  • Sexual battery and rape — In Florida, rape is referred to as sexual battery or sexual assault This charge is often subject to questions about consent and false allegations. It carries the harshest of all sex crime penalties — a minimum of nine years to a maximum of life in prison.
  • Unlawful sex with minors — If the alleged offender is 24 or older and has sex with a minor aged 16 to 17 — even if the act was consensual ­— that offender can be charged with unlawful sexual activity with statutory rape.

All these crimes are considered to be felonies and require sex offender registration. Other chargeable sex offenses include prostitution, failure to register as a sex offender, indecent exposure and voyeurism.
